A. General
1. These Terms and Conditions govern all contractual relations between 2protect GmbH and its business or contractual partners.

B. Admittance to courses and instructions
2. The minimum age for participation in the courses and for purchase of a subscription is 18. Exceptions to this minimum age will be clearly declared in the course descriptions (courses or subscriptions specifically designated as courses for children or adolescents).
3. Individuals with prior convictions of violent or capital crimes will not be admitted to courses and are excluded from purchasing a subscription. An excerpt from police or criminal records must be provided to 2protect GmbH if required.
4. Anyone who provides false or incomplete information or who conceals facts relevant to clauses 2 and 3 of these Terms may, with immediate effect, be excluded from attendance of classes. In such a case, no claim for refund of course and subscription fees exists.
 
C. Rights and Obligations of the course participants and subscribers
5. The full course fee must be paid prior to the beginning of the course (via bank transfer or cash payment). Subscription fees must be paid within 10 days of the beginning of the term. A processing fee of Fr. 20.00 will be charged for issuance of a payment reminder.
6. In case of unsubstantiated cancellation of the course by the participant or in case of non-attendance, the participant will be charged as follows:
    - 50% of the course fee in case of a cancellation 21 to 10 days before the beginning of the course
    - 70% of the course fee in case of a cancellation 9 to 2 days before the beginning of the course
    - 100% of the course fee in case of a cancellation 2 days (48 hours) before the beginning of the course or in case of non-attendance.
7. The course participant will be fully or partially refunded the course fee in the form of credit for a future course (credit must be redeemed within 6 months of issuance) in the cases listed below, or in case of a permanent incapability to attend the booked course:
    a) In case of illness or physical injury prior to the beginning of the course or during the course itself (a medical statement or a certificate must be provided)
    b) In case of death of a family member or a close friend.
    Other reasons do not entitle members to a refund of course fees.
8. Subscriptions will be automatically renewed for the same time duration unless a written notice of termination of the subscription is provided 14 days before the end of the subscription period. A premature termination of the subscription is not possible.
9. Suspension from training is possible for a period of at least two months if the course participant fills out and hands in the appropriate form to the school director at least 10 days before the desired beginning of the interruption, or in case of a suspension of at least two months due to an accident, physical injury or illness (a medical statement is required in these cases). A training suspension extends the length of the subscription by the corresponding time period. A processing fee of SFr 20.00 will be charged.
10. Should a new member purchase a yearly subscription thanks to an existing member who motivated them to join, the existing member will receive course credit for one month (an extra month added to their existing subscription).
11. Each owner of a subscription automatically becomes a member of the dedicate Association. Each member bears the costs of the membership card and the licence stamp of the Association.
12. All course participants and owners of subscriptions must have a valid accident insurance. 2protect GmbH is not liable in case of accidents.
13. Course participants must strictly adhere to the instructions given by the course instructors and trainers.
14. Course participants and owners of subscriptions shall be held liable should damage to training equipment occur through improper or inappropriate usage on their part.

D. Rights and Obligations of 2protect GmbH
15. 2protect GmbH sets the course and subscription fees.
16. 2protect GmbH defines the contents and the duration of courses.
17. 2protect GmbH reserves the right to engage instructors, trainers and consultants from other organisations.
18. The school is closed on public holidays and between Christmas and New Year. During school holidays a reduced training plan may be in effect or the school may be closed entirely. Additionally, the school reserves the right to cancel trainings on single days for operational reasons. Such cancellations do not entitle members to a refund of course fees.
 
E. Disclaimer
19. 2protect GmbH is not liable for itself or for persons employed or engaged by it. 2protect GmbH is not liable for damages or injury inflicted by course participants on others during a course.

F. Final Clauses
20. Should one or more stipulations of these General Terms and Conditions be rendered invalid by means of a court order, the validity or applicability of the remaining stipulations will not be affected.
21. The General Terms and Conditions of 2protect GmbH are subject to Swiss law. The court of jurisdiction is Zurich.
